Important: GoldenPhotos can help you select photos and videos for deletion. Similarity, blur, quality, duplicate, and best-shot recommendations may be imperfect. You are responsible for reviewing your selections and maintaining backups before confirming deletion.

These Terms of Use ("Terms") are a legally binding agreement between you and A4TEAMS regarding GoldenPhotos applications for macOS, iOS, iPadOS, Android, the website goldenphotos.a4teams.com, and related services ("Services"). By installing, accessing, purchasing, or using the Services, you agree to these Terms and the Privacy Policy.

1. Eligibility

You must be legally capable of entering a binding agreement in your jurisdiction. If you use GoldenPhotos for an organization or another person, you represent that you have authority to do so and to manage the media you provide to the app.

2. License

Subject to these Terms, A4TEAMS grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to use GoldenPhotos on devices you own or control for its intended purpose.

3. Product Functionality

GoldenPhotos may identify exact duplicates, similar photos, bursts, blurry/low-quality media, best-shot candidates, screenshots, screen recordings, RAW/Live Photo media, large files, and estimated reclaimable storage. On macOS it may also scan authorized folders or external storage.

4. Deletion and Data-Loss Risk

You make the final deletion decision. Recommendations and pre-selections are not guarantees that an item is unwanted. You are solely responsible for reviewing selected items before deletion.

You should independently back up media that is important, including family memories, professional work, legal evidence, receipts, tax documents, medical records, creative originals, or any irreplaceable content.

5. Cloud Synchronization

If your library is synchronized through iCloud Photos, Google Photos, another cloud provider, NAS, or device-manufacturer service, deletion may propagate to other devices or cloud copies according to that provider's rules. GoldenPhotos does not control those rules.

6. Recently Deleted / Trash

Some platforms may move deleted media to Recently Deleted, Trash, Bin, or a similar recovery area. Availability and retention periods are controlled by the operating system or cloud provider. You must not rely on this as your only backup.

7. Algorithmic and AI Recommendations

GoldenPhotos may use cryptographic hashes, perceptual hashes, metadata, heuristics, computer vision, and on-device machine-learning. Unless explicitly described as a verified exact match, classifications are estimates and recommendations. "Best shot" is subjective. "Blurry" may include intentionally artistic images. "Similar" does not mean identical.

8. Storage Estimates

Displayed reclaimable-space figures are estimates. Actual space recovered may differ due to filesystem allocation, cloud optimization, caches, Live Photo components, RAW/JPEG pairs, operating-system deduplication, or Recently Deleted retention.

9. Permissions

You authorize GoldenPhotos to access only media and storage locations you permit through your operating system. Revoking permission may disable or reduce scanning and cleanup functionality.

10. Purchases and Subscriptions

GoldenPhotos may offer free features, trials, subscriptions, one-time purchases, or a Mac lifetime option. Prices, taxes, features, and availability may vary by platform and country.

Purchases made through Apple App Store or Google Play are billed and administered by those stores. Auto-renewing subscriptions renew according to the terms shown at purchase unless canceled through the applicable store. Deleting the app does not necessarily cancel a subscription.

If offered, "lifetime" means the commercially reasonable life of the GoldenPhotos product/entitlement on the applicable platform, subject to platform compatibility, legal requirements, and continued product availability. It does not guarantee every future feature or service forever.

11. Acceptable Use

Do not use GoldenPhotos unlawfully or to violate another person's rights.
Do not circumvent security, licensing, subscription, or purchase verification.
Do not reverse engineer except where applicable law expressly permits.
Do not use GoldenPhotos to delete media you are not authorized to manage.
Do not interfere with or attack the Services.

12. Intellectual Property

GoldenPhotos software, branding, designs, algorithms, interfaces, graphics, and documentation are owned by A4TEAMS or its licensors. Your photos and videos remain yours or the property of their respective owners.

13. Feedback

If you voluntarily provide product feedback, suggestions, or bug reports, you permit A4TEAMS to use that feedback without obligation or compensation, without transferring ownership of your personal media.

14. Third-Party Services

Apple, Google, cloud-photo providers, app stores, operating systems, and other third parties are independent from A4TEAMS. We are not responsible for their outages, policies, synchronization behavior, pricing, security, or changes.

15. Service Changes

We may add, modify, suspend, or discontinue features for safety, security, compatibility, legal, operational, or business reasons, subject to rights that cannot be waived under applicable law.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDENPHOTOS IS PROVIDED "AS IS" AND "AS AVAILABLE." A4TEAMS DISCLAIMS EXPRESS, IMPLIED, AND STATUTORY WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND ERROR-FREE OPERATION.

We do not warrant that all duplicates will be found, all recommendations will be correct, storage estimates will be exact, deleted content will be recoverable, or the Services will always work with every device, format, cloud provider, or operating-system version.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, A4TEAMS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, PHOTOS, VIDEOS, MEMORIES, BUSINESS OPPORTUNITY, GOODWILL, OR USE, ARISING FROM OR RELATED TO THE SERVICES.

To the maximum extent permitted by law, A4TEAMS's aggregate liability for all claims related to GoldenPhotos will not exceed the greater of the amount you paid for GoldenPhotos during the 12 months before the event giving rise to the claim or US $50.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights.

18. Indemnification

To the extent permitted by law, you agree to indemnify A4TEAMS for claims arising from your unlawful use of the Services, violation of these Terms, infringement of third-party rights, or management of media you were not authorized to access.

19. Suspension and Termination

You may stop using GoldenPhotos at any time. We may suspend or terminate access where reasonably necessary to address fraud, abuse, security risks, legal requirements, or a material breach of these Terms. App-store subscriptions must still be canceled through the applicable store.

20. Governing Law and Disputes

These Terms are governed by laws applicable to A4TEAMS at its principal place of business in the United States, except where mandatory consumer law in your jurisdiction provides otherwise.

Before filing a formal dispute, you agree to contact hello@a4teams.com and make a good-faith attempt to resolve the matter informally for at least 30 days, unless applicable law or urgent relief makes that impracticable.

21. Export and Sanctions Compliance

You may not use or export GoldenPhotos in violation of applicable export-control, sanctions, or trade laws.

22. Changes to These Terms

We may update these Terms for legal, security, operational, or product reasons. Material changes will receive additional notice where required.

23. Severability and Entire Agreement

If a provision is unenforceable, the remaining provisions remain effective. These Terms, the Privacy Policy, and applicable purchase terms form the agreement regarding GoldenPhotos.

24. Apple App Store Terms

If you obtain GoldenPhotos through Apple's App Store, these Terms are between you and A4TEAMS, not Apple. Apple is not responsible for the app or its content and has no maintenance/support obligation except as required by its own terms. Apple and its subsidiaries may be third-party beneficiaries of provisions applicable to licensed App Store use where required by Apple's rules.

25. Google Play Terms

If you obtain GoldenPhotos through Google Play, use and billing are also subject to applicable Google Play terms. Google may administer purchase, cancellation, renewal, and refund processing.
